3. Privacy and Data Collection

4. Testimonials and Submissions
Any feedback, suggestions, ideas, testimonials, or other content submitted to OITS (“Submissions”) shall become the sole property of OITS. By submitting, you grant us the unrestricted right to use, reproduce, and display these Submissions for marketing and promotional purposes without compensation or acknowledgment.
5. SMS Terms of Service
By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from Optimal IT Solutions LLC. This includes SMS messages for appointment scheduling, appointment reminders, post-visit instructions, lab notifications, and billing notifications. Message frequency varies. 6. Electronic Communications
When you use our website or send us an email, you communicate with us electronically. You consent to receive communications from us electronically and agree that such communications satisfy any legal requirement that such communications be in writing.
7. Copyright Infringement Claims

- A statement of good faith.
- Your electronic or physical signature.
8. Refund Policy
Refunds are subject to the following conditions:
Refunds will not be granted if:
- A special or promotional package was purchased.
- The initial design has been approved or revisions have been requested.
- You have not contacted us within 14 calendar days of order placement.
- The project was canceled for reasons unrelated to OITS.
- You engaged another service provider for the same project.
- The creative brief lacked sufficient detail.
- A full design change was requested.
- The business name or ownership changed after service initiation.
- You requested a refund due to change of mind or internal disagreement.
Additional Notes:
- Refund requests must be made within 15 days of purchase.
- In bundled service packages, partial refunds may be granted only for the unsatisfactory service.
- Services such as SEO, domain registration, hosting, and social media are non-refundable.
- For website projects, no refunds are issued after design approval.
- If initial designs are rejected outright and no revisions requested, a full refund may be considered.
- In cases where design work has been delivered and the client cancels, OITS may retain up to 33% as processing and service fees.

Once processed, refunded customers will have no right to use the delivered designs. All rights revert to NEXSTACKSOLUTIONS.
9. Satisfaction and Revision Policy
We offer unlimited revisions within the scope of your purchased package. Revisions are processed within 48 hours of request. Any changes after final approval or outside of the original scope will be treated as a new project and billed accordingly.
10. Account Area Responsibility
Clients are responsible for checking their Account Area regularly for updates, design proofs, or requests. Inactivity or delay in communication will not qualify as grounds for refund.
11. Delivery Policy
All deliverables will be sent to the client’s registered account and confirmed via email. Delivery timelines vary by package, with a minimum turnaround of 2 business days. Urgent requests may incur additional charges.
12. Record Maintenance
OITS retains records of finalized work for internal use and re-delivery upon verified request.

OITS is not responsible for communication conducted outside of official channels listed above.
14. Applicable Law and Jurisdiction
These Terms shall be governed by the laws of the State of Texas. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Austin, Texas.
15. Dispute Resolution
For any concerns or disputes, clients must first contact our Dispute Resolution Department. If unresolved, legal proceedings shall be held in the appropriate court in Austin, TX.
16. Modifications and Severability
OITS reserves the right to update or modify these Terms & Conditions at any time. If any provision is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
17. Anti-Fraud Policy
Use of stolen or fraudulent credit cards is strictly prohibited. OITS cooperates with state and federal authorities to prosecute cybercrime.
18. Final Acceptance and Disclaimer
Client approval at any project stage indicates satisfaction. After final delivery, OITS is not responsible for business outcomes, third-party issues, or post-delivery changes of mind. Unlimited revisions are available during the design phase to ensure complete satisfaction.
